Jury begins to ponder evidence in jewellery store murder trial
Credibility the Issue. Judge cautions jurors: Key witness gave some 'odd' testimony
SUE MONTGOMERY, The fate of Steven Travers, charged with killing a popular Cote des Neiges jewellery store owner, is now in the hands of the jury.
After almost four weeks of listening to evidence, the seven men and five women now must decide whether it was Travers, 46, who entered the Victoria Ave.
store on Sept. 22, 2005, and shot Baldev Singh Nagi three times.
Superior Court Justice Claude Champagne cautioned the jury yesterday about "a certain number of odd answers" given by the Crown's main witness, Nancy Dube, during her testimony.
Dube, 33, pleaded guilty to having taken part in the armed robbery of the store, and is now serving four years.
She told the court it was Travers's idea to hold up the shop, and once inside, it was Travers who pulled the trigger on the .357 magnum pistol.
Champagne also pointed out problems with the testimony of Dube's boyfriend, Pierre Savard.
"This very special gentleman has a lengthy criminal record of which I found he was very proud," said the judge, pointing out that since 1975, Savard has been convicted more than 50 times.
The jury should consider the fact that no DNA or fingerprints of Travers were found in or around the store, but DNA of another, unidentified man was found on the weapon used to killed Nagi and under the fingernails of the victim.
The only DNA found that matched Travers's was in the back seat of the getaway car, the judge pointed out.
When police tried to pull Travers over on Sept. 25, he took them on a high-speed chase, followed by one on foot.
"The fact he had a .
357 magnum, a rock of crack in his pants and a .22 revolver could've been the reason he was running from police," Champagne said. "It could be distinct from the things that happened on Sept.
22."
Police also recovered four rings - three in Travers's apartment and one on his girlfriend. But the victim's stepson testified that while three of the rings looked like ones they had in the shop, those rings are mass produced and available in many places in Montreal.
He wasn't sure whether the fourth ring was from his stepfather's store.
In the end, the judge said, the key question the jury has to answer is, "Who was the person with Nancy Dube that day?
