In a counterclaim, Dabrowski said she didn't want a family with Toomer because she didn't feel he would be there "emotionally or physically" for their child. She also accused Toomer of being egotistical, paranoid and insecure and of trying to discourage her from pursuing a career as a chiropractor and from attending law school. Toomer and Dabrowski arrived in court at about 2:30 p.
m., each dressed in a dark business suit. They studiously avoided looking at each other as they sat about eight feet apart at a long table in the court of Family Judge Maureen B.
Mantineo. After a delay of about 30 minutes, they conferred with their attorneys in opposite corners of the courtroom. After more discussions in separate chambers, Mantineo dismissed the two sides until Wednesday morning.
"I have no idea," Toomer said as he left the court when asked if the parties had moved closer to a settlement. "I just want everything to go smoothly." Toomer's lawyer, Robert L.
Penza _ who also represented Giants defensive Michael Strahan in his contentious divorce battle with his former wife, Jean _ said, "We've made some progress on some things." "We came very close," he said, adding that his client "unquestionably" wants a settlement in the case. "All Ms.
Dabrowski wants is a fair resolution of this, with dignity and respect for all the parties involved," Snyder said. In a complaint that dates to December 2005, Toomer said that Dabrowski, 34, refused to undergo treatment for depression and often smoked in his presence despite knowing that it aggravated his asthma. Toomer's complaint characterizes Dabrowski's actions as a "fraud against the essentials of the marriage.
" The couple were married in October 2002 in Las Vegas and lived in Weehawken, across the Hudson River from Manhattan. Dabrowski is seeking a divorce. She charges that Toomer was "unduly demanding" for sex _ once urinating on her clothing when she declined his advances.
She also said in court papers that Toomer accused her of infidelity, once threw her BlackBerry into the Hudson and stole her computer on the eve of exams during her first year of law school. A divorce would allow Dabrowski to receive alimony and half the marital assets. But if the marriage is annulled, she would not be entitled to those considerations.
Toomer is in the middle of a five-year, $20 million contract with the Giants. Toomer, 32, has spent his entire 11-year NFL career with the Giants and is the team's second-leading all-time receiver behind Tiki Barber. In 2006 he suffered a knee injury against Houston on November 5 and missed the rest of the season.
